Terms of Service

1. Acceptance & the Service
These Terms of Service (“Terms”) govern your access to and use of the Yazoray platform, websites, and services (collectively, the “Service”), operated by Mamoun ELAAMMOURI, doing business as Yazoray (“Yazoray,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms; if you do not agree, do not use the Service. Yazoray is a software platform that lets food truck operators (“Owners”) create a public page, manage a menu, display their real-time location, and accept online pickup pre-orders from their customers (“Customers”). Each Owner’s page is hosted at a Yazoray URL (for example, yazoray.com/your-name). Yazoray provides the software; Owners are solely responsible for their food, menu, pricing, fulfillment, and compliance with applicable laws.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.
3. Accounts
You are responsible for your account credentials and for all activity under your account. You agree to provide accurate information and keep it up to date. Notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.
4. Subscriptions, Pricing & Billing (Owners)
Access to Owner features requires a paid subscription. Current pricing is a 14-day free trial, followed by an introductory rate of $0.99 for the first month, then $19.99 per month, billed automatically until canceled. Prices may change with notice. Subscriptions renew automatically each billing cycle, and you authorize us and our payment processor to charge your payment method on a recurring basis. You may cancel your subscription at any time from your dashboard; cancellation takes effect at the end of the current billing period, and your page remains visible but stops accepting orders. Except where required by law, subscription fees already paid are non-refundable. Yazoray does not charge any commission or percentage on your order sales.
5. Payments and Stripe
Payments are processed by Stripe, Inc. (“Stripe”). By using payment features, you also agree to the Stripe Connected Account Agreement and Stripe’s terms. Owners must connect and maintain a Stripe account to receive Customer payments. Customer payments for orders are collected through Stripe and settled to the Owner’s connected Stripe account, minus Stripe’s processing fees. Yazoray is not a party to the transaction between an Owner and a Customer and is not responsible for that transaction, including fulfillment, refunds, chargebacks, or disputes.
6. Owner Responsibilities
As an Owner, you are solely responsible for the accuracy of your menu, prices, hours, and location; for holding all required licenses, permits, and food-safety certifications; for preparing and fulfilling orders; and for handling Customer questions, refunds, and disputes related to orders, as well as complying with all applicable laws and tax obligations. You represent that you have the right to use any content — names, logos, photos, or menu text — that you upload.
7. Orders (Customers)
Orders placed through the Service are for pickup. The Owner — not Yazoray — is the seller of all food and the party responsible for the order. Refunds for an order are issued by the Owner. Estimated pickup times are provided by the Owner and are not guaranteed by Yazoray.
8. AI Menu Import
The Service can read a photo of a paper menu and automatically generate menu items and prices. This automated process may contain errors. You are responsible for reviewing and correcting the generated menu before publishing it. Yazoray is not liable for inaccuracies in automatically generated content.
9. Acceptable Use
You agree not to use the Service for any unlawful purpose, upload false, misleading, infringing, or harmful content, attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service, or resell or misuse the Service. We may remove content or suspend accounts that violate these Terms.
10. Intellectual Property
The Service, including its software, design, and trademarks, is owned by Yazoray and protected by law. You retain ownership of the content you upload, and you grant Yazoray a non-exclusive, worldwide license to host, display, and use that content as needed to operate and promote the Service.
11. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Limitation of Liability
To the maximum extent permitted by law, Yazoray and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars ($100).
13. Indemnification
You agree to indemnify and hold harmless Yazoray from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your orders, or your violation of these Terms or applicable law.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Provisions that by their nature should survive termination — including payment obligations, disclaimers, limitation of liability, and indemnification — will survive.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. You agree that any dispute will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.
